I didn't realize HackMaster used level limits. I dislike such rules personally. Having said that I think your player has been a clever munchkin and probably should be allowed to get away with this tweak. 
However, he would probably have to cast the spell again for each level he wants to gain above his level limit.
If you wanted to be really cruel about it you could say that once the spell ends any benefits from being above the level limit will also be removed since they are features of another race?
